“If your child is under 21 years old at the time of your divorce, he or she will be under the mother’s custody,” Margarete said. However, this may not always be the case if the mother is not under curatele (guardianship), and if she is unable to take care of and raise a child –e.g. have mental instability or abusive behaviors. This decision is made by the court.

If you do have custody of your child(ren) you are also entitled to child support allowance from your soon-to-be ex-husband. Margarete said, “As long as the child is under the mother’s custody, the mother is entitled to child support allowance from her husband until the child is of age, regardless of whether the mother remarries or not.” Unfortunately, this obligation is often neglected by the ex-husband.
